These Terms govern your use of the SalesApex software-as-a-service application (the "Service"), operated by BA Media & Marketing LLC. By creating an account or using the Service you agree to these Terms.
SalesApex is a field-sales and job-management tool for contractors. It provides lead and follow-up tracking, a shared team calendar, estimate/invoice creation, contract e-signature, project management, a job map, team messaging, and related features.
The person who registers a company is its owner. Owners may invite team members and assign roles (for example Salesperson, Office Admin, Dispatch, Runner), which control what each member can see and do. You are responsible for your team members' use of the Service and for keeping login credentials secure. Deactivating a member ends their access.
The Service can generate draft text — scopes of work, estimate language, and follow-up messages — using a third-party AI model (Anthropic's Claude). AI output is a draft and may be inaccurate or incomplete. You are responsible for reviewing and editing any AI-generated content before sending it to a customer or relying on it. See our AI Disclaimer. SalesApex does not warrant the accuracy of AI-generated content.
You retain ownership of the information you enter, including your customers' personal information (names, addresses, phone numbers, email addresses and job details) and any photos you upload. You represent that you have the right to enter that information and to send documents, emails and text messages to the people you contact through the Service. You are the controller of your customers' personal information; SalesApex processes it on your behalf to provide the Service. See our Privacy Policy.
The Service can send emails on your behalf (via Resend) from a verified sending domain, and can collect electronic signatures on contracts and change orders. You are responsible for the content and legality of what you send, for having a lawful basis to contact recipients, and for compliance with applicable communications laws (for example CAN-SPAM and, where you send text messages, the TCPA).
You agree not to misuse the Service, including by uploading unlawful content, attempting to breach security or access other companies' data, using the Service to send spam or unlawful communications, or reverse-engineering the Service.
The Service relies on third parties to function, including Stripe (payments), Google Maps and Places (address lookup and maps), Anthropic (AI drafting), Cloudflare R2 (file storage), Resend (email delivery), and our hosting provider. Their availability and terms are outside our control. A current list is on our Subprocessors page.
The Service is provided "as is" and "as available" without warranties of any kind to the fullest extent permitted by law.
You may stop using the Service at any time. We may suspend or terminate access for violation of these Terms or non-payment. On termination you may request an export or deletion of your data as described in the Privacy Policy and Data Deletion page.
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules.
We may update these Terms; material changes will be posted here with a new "last updated" date. Continued use after changes take effect constitutes acceptance.
